Shay Tressa DeSimoneLegal matters can be very complicated in such a unique city as Las Vegas, especially when alcohol is involved. Even away from the famous Strip, officials need to be concerned about the easy access to alcohol, while retaining freedom for businesses to acquire liquor licenses and adults to purchase that liquor.

In an effort to expand the downtown district, Las Vegas has allowed a large number of liquor licenses over the last number of years, resulting in an explosion in the amount of bars and liquor stores in the area. Now the City Council is looking for ways to slow down the proliferation of these establishments, in an effort to make the district more family friendly.

So far, no action has been taken, but the City Council is still deciding how they want their downtown area to appear — the party atmosphere of New Orleans’s Bourbon Street, or the wider appeal of San Diego’s redeveloped Gaslamp Quarter.

doviendeJust about everyone has had a brush with the law in their lifetimes, even if it is only a parking ticket or a police stop. Sometimes, that brush becomes a more involved case, with charges leveled. No matter what the accusation, it is a terrifying experience to be so accused, and it can be very difficult to determine where to turn. Everyone is innocent until proven guilty, but a good attorney is still necessary to make sure all rights are respected and observed.

A Las Vegas physician was recently arrested on charges arising from Syracuse, N.Y. He was indicted, along with an employee of his, on charges of Medicare fraud. According to prosecutors, he and his employee falsely submitted claims for reimbursement for medical services that had never been performed. There were also further charges of unlawfully distributing powerful painkillers like oxycodone.

Cases such as the one detailed above may seem open and shut, but the reality is that most cases can be fought, with the right advocates on your side. Wikimedia CommonsGregg Allman’s life has been interesting. He’s been awarded many accolades, but is still no stranger to tragedy. He’s lost his brother and bandmate to vehicle crashes.  He’s been revered as one of the best musicians in southern rock. A train crash that happened in the outskirts of Savannah is just another chapter, although a sad one.

Crews were working on the production of “Midnight Rider,” a film based on Gregg Allman’s biography, “My Cross to Bear.”  They were using land that was owned by the Rayonier paper products company, and they had written permission to use this land.  The place, located around 60 miles outside of Savannah, was right near the Altamaha River in Jesup, GA.

A train came barreling down the tracks while they were filming the movie, killing one and injuring six in the process.  There is some question about whether CSX knew that there was filming happening on their tracks.  They issued a statement saying that they were cooperating with investigators and that they were deeply saddened.

Ken LundWhen was the last time that you saw an accident on the side of the road?  When was the last time that you stopped to help the people who were involved in that accident?  There was a rollover accident near mile marker 10 on Needles Highway.  Nobody was there, nobody had come to help, so a 72-year-old Laughlin man decided to stop his vehicle on the side of the road, cross traffic, and help out.

It was the good thing to do.  The neighborly thing to do.  Unfortunately, this man’s neighborly efforts resulted in his own death.  He crossed over from east to west to help a struggling motorist, but in the process he was hit by a southbound Honda Element.  The driver of the Element waited for police to arrive, and one can only hope that the person (or people) involved in the rollover crash were attended to, as well.  The man was sent to UMC Trauma center, but it was still not going to be a happy day.  He was pronounced dead upon arrival.

This makes the 14th traffic fatality in the LVMPD’s jurisdiction since the beginning of the year.  The accident itself is still being investigated, and one hopes that the final resolution is clear and accurate.

Flamingo RoadPedestrian accidents can happen for any number of reasons. You may be surprised to know that numbers for who is at fault in these accidents are about equal for each side. Both drivers and pedestrians can make critical errors. Unfortunately for pedestrians, they receive the brunt of the injuries.

Determining whose fault it is has major repercussions. A pedestrian who broke the law and caused an accident will have a much harder time getting any financial compensation. Take this case that happened on Flamingo Road recently. A 54-year-old man is now in ICU because a driver struck him. However, after a 4.5 hour investigation, police have determined that the man was crossing against the light and that the truck turned left legally. Police haven’t come to a final decision as to whether charges will be filed.

Should the truck have stopped in the middle of the left-hand turn to let the pedestrian by? That remains for the courts to decide. The facts have to be gathered and analyzed by competent legal officials. Don’t leave your fate in the hands of the courts. Whether you’ve been charged with a crime, or you’re fighting for legal restitution, call the law offices of Hofland & Tomschek. Wikimedia CommonsIt was an otherwise uneventful Sunday afternoon.  Nneka Geter, 42, was working to provide for her family by getting a broker’s license, but now she won’t have a chance to use it.  On her way home from church, her and her family were in an accident with a 17-year-old driver. It killed the mother at the scene.

This tragic event placed all of the family’s plans in jeopardy.  What to do now? Where to go from here?  There were at least two kids who were in the car with Nneka Geter – her 16-year-old daughter and 18-year-old son.  The daughter is recovering nicely and is expected to be released soon.  The son is still in the hospital with severe injuries.

The intersection near Tropical Parkway and Durango Drive will forever hold bad memories for the Geter family, as it was at this intersection that everyone’s life got turned upside down.   Nothing can replace the loss of a loved one in an accident, and nothing can really fill that hole that was ripped open on that day.

WikipediaSometimes an accident is reported with little information. Outside the West Pioneer Boulevard Holiday Inn Express, police were called to the scene of an accident just a little after 7pm. A rollover accident had trapped the driver, forcing the fire department to use the Jaws of Life.

Once freed from the confines of her vehicle, she was moved to Mesa View Regional Hospital. There, she was quickly assessed and flown to the University Medical Center where the facilities were more appropriate to her injuries and her demeanor. Authorities are investigating this accident.

Nobody knows why the rollover accident happened. Perhaps it was mechanical failure. Perhaps the driver was speeding a little bit. Who knows? What we do know, however, is that people who have received personal injuries in Las Vegas should consult a trained, experienced attorney.

WikipediaSport utility vehicles are a very popular choice of vehicle, but they have a dangerous safety flaw. They are very top-heavy, which makes them prone to rollover accidents. Rollover accidents are among the most dangerous of accidents. The roofs of vehicles aren’t necessarily designed to take the weight of a car upside down, especially when thrown over with force.

One pair of SUVs is lucky after an accident off I-15 South. It happened just after morning rush hour. The vehicles were on the Cheyenne on-ramp when they collided. One of the SUVs rolled onto the shoulder of the ramp as a result of the collision. The driver of that SUV was taken to University Medical Center with injuries. Luckily, they do not appear to be life-threatening.

If the drivers are lucky, insurance will take care of the car repairs and the injuries. However, this isn’t always enough. In fact, many drivers are stuck with high medical and repair bills because the other parties did not carry enough insurance, or even any insurance at all. When this happens, it’s time to get legal advice from an attorney that knows civil injury law.

WikipediaMurder case are some of the most difficult cases to try in court. Because the punishments are so severe, and the charges so heinous, everyone wants to make sure that the accused gets a fair day in court. That is why it is so important to have a skilled defense attorney on your side, one who can take the time to dig into the facts and give your case the attention it deserves.

When a news story reports on murder cases, all they have are the police’s side of the story. Take one recent example about a bar fight where a man died. At the Loose Caboose Bar on Flamingo Road, officers were called out to respond to an altercation around 4:30 AM. When officers arrived, a man was found unconscious. By the time he was taken to the hospital, he was dead.

Police say that he got into a verbal argument that escalated into a physical confrontation. The man was knocked to the ground and received injuries. The man he was fighting with has been charged with open murder.

Wikimedia CommonsMiracles happen every single day. The parents of Brazyl Ward, a 6 year old who was traumatically injured by a hit and run driver, can testify to that fact. Brandon and Tiffany Ward watched their daughter recover from a coma while doctors gave slim chances of whether she would wake up ever again.

Fortunately, she did wake up from the accident that happened on Halloween night, and she’s even slowly recovering from the brain injuries that she’s incurred. She’s fighting back, which is the best news that the entire Ward family can hope for.

She’s learning how to cope with her injuries one day at a time as she recuperates in a facility that’s designed just for children. Each day is a new challenge, “I’m doing it,” the six year old says brightly. “I feel so much better now!”
